Нередко на входе в магазин охранник настойчиво предлагает посетителям сдавать сумки в камеру хранения. При этом рядом можно заметить надпись: «Администрация не несет ответственности за сохранность вещей в ячейках». Законно ли это? Нет. Разберемся, как поступать в такой ситуации.

Обязательно ли сдавать вещи в камеры хранения в магазинах?

Требование сдать сумку с юридической точки зрения квалифицируется как принуждение к заключению договора. Оно незаконно, так как противоречит ст. 421 Гражданского кодекса Российской Федерации о свободе заключения договоров. Более того, «Постановление о розничной торговле» запрещает требовать от покупателей сдавать сумки в камеры хранения при входе в супермаркет. Таким образом, если вы не хотите добровольно оставлять личные вещи в ячейке, то не оставляйте: законодательство не обязывает вас это делать.

Если охранник настаивает, уведомьте его, что его действия противозаконны – они нарушают ст. 426 ГК РФ о публичности договора. Если этого окажется недостаточно, пригласите администратора. Уведомьте его, что напишите жалобу в Роспотребнадзор о нарушении правил торговли. Как правило, претензии исчезают сразу же.

Что делать, если украли вещи из камеры хранения?

Дальнейшие действия:

1Главное правило – сохраните ключ с номером ячейки. Это единственное подтверждение факта сдачи вещи на хранение и, согласно п. 2 ст. 887 ГК РФ, приравнивается к заключенному договору. Если вы отдадите его сотрудникам магазина, доказать факт передачи имущества будет невозможно.

2Зафиксируйте, какие вещи были оставлены. Для этого письменно потребуйте предоставить видеозапись с камер наблюдения. Чтобы доказать, какие предметы были в сумке, подойдут показания свидетелей и любые другие факты.

3На основании этого сделайте калькуляцию похищенного. Для этого подойдут сохранившиеся чеки, а при их отсутствии – ваша личная оценка.

4Напишите претензию на имя администрации торговой точки. Документ отправьте заказным письмом с описью вложения. Адрес вы найдете в «Уголке покупателя».

5Подайте иск в суд, если администрация магазина откажется возместить ущерб добровольно. Как показывает судебная практика, требования истцов удовлетворяются в полном объеме.

Несет ли ответственность магазин за сумки в камере хранения?

Несмотря на заявления о том, что администрация не несет ответственности за сданные на хранение личные вещи, это не так. Такая ответственность существует, согласно ст. 426 и 924 ГК РФ.

Согласно ст. 901 ГК РФ, заведение обязано возместить стоимость пропавшего имущества. Согласно п. 2 ст. 401 ГК РФ, покупатель не обязан доказывать, что в хищении виноват магазин.

Чтобы отстоять законные права, их надо знать. Используя информацию из нашей статьи, вы не позволите их нарушать сотрудникам магазинов.
